Pesticide Dealers

The Colorado Department of Agriculture enforces the Pesticide Act, which allows for licensing of pesticide dealers.

Any person who distributes any federal or state restricted-use pesticide (RUP) or any state limited-use pesticide (LUP) to any other person must be licensed by the CDA as a Pesticide Dealer. 

Pesticide distribution is defined as advertising, offering for sale, holding for sale, selling, bartering, or supplying in any fashion.

Pesticide Dealer Requirements

Each separate business location, including branch offices, and each separate business name, must have a separate pesticide dealer license.

 

  • Federal RUPs are for distribution only to certified applicators, their authorized agents or other licensed dealers.

     

  • State RUPs are for distribution only to certified applicators, their authorized agents or other licensed dealers.

     

  • State LUPs are for distribution to consumers only by licensed dealers.

 

Licensed dealers must keep detailed records or each distribution of a federal or state RUP. LUP sales do not require recordkeeping. 

Certified applicators are persons holding a Colorado Private Applicator or Qualified Supervisor license in the corresponding category to the desired pesticide product type.

Businesses which only sell pesticide products that do not fall under a state or federal RUP or LUP are not required to obtain a pesticide dealer license.

(ยง2-5-118, C.R.S.).


Colorado's State Restricted & Limited Use Pesticides (RUP & LUP)

Any herbicide product that contains one or more of the following active ingredients is a Colorado State Restricted Use Pesticide (State RUP).

  • Bromacil
  • Diuron
  • Monuron
  • Prometon
  • Sodium Chlorate
  • Sodium Metaborate
  • Tebuthiuron

 

Beginning July 1, 2024, pesticide products containing the following neonicotinoid active ingredients and do not meet the listed product type exemptions, are considered "limited - use" pesticides any may only be sold by a licensed dealer. (State LUP)

The active ingredients are: 

  • Acetamiprid
  • Clothianidin
  • Dinotefuran
  • Imidacloprid
  • Nitenpyram
  • Nithiazine
  • Thiacloprid
  • Thiamethoxam

Products that are pet care products, veterinary products, indoor pest control products, personal care products for lice, products used in structural insulation, wood preservative products, bait products, insect strips, and products used in academic research are exempt from this requirement and are not considered "limited-use."

Restricted Use Pesticide Sales Record-Keeping

Licensed pesticide dealers must maintain records of all distributions of a RUP, for 2 years. LUP sales do not require record-keeping. 

These records must include the following:

  • Name of the licensed applicator or licensed dealer who purchased the product.
  • Name and address of the applicator's principal place of business.
  • The certification number, issuing entity, expiration date, and categories of the applicator's license.
    • Or, for distributions to another RUP dealer, the pesticide dealer license number.
  • The product name
  • EPA registration number, and CO Special Local Need label number, if applicable
  • The quantity of the pesticide sold.
  • Date of the transaction.

For distributions to an authorized agent of the licensed applicator, the above must be recorded and:

  • Name and address of an authorized agent.
  • A record of the applicator's license, including license categories.
  • A signed statement from the licensed applicator authorizing the agent to receive delivery of restricted use pesticides on behalf of that applicator.

Pesticide dealers are licensed by each physical location. Licenses are $50.00. All licenses expire January 1st each year and must be renewed annually.

Renewals are processed online through the Colorado Department of Agriculture's web application AgLicense

Once your license is approved, you will receive an email from cda_pesticide_dealers@state.co.us with information on how to set up your online account. 

Payments may be made with a credit card or electronic check. The renewal fee is $50.00. 

  • If your license is not submitted for renewal by the first working day of January, at late fee of 10% will be applied. If you do not renew your license, you cannot advertise, hold for sale, or provide in any fashion any restricted use pesticide. 
  • If your license is not renewed by February 1st, the license will be revoked and the dealer must apply for a new license. 

You must notify us of changes to the company name, entity type, or business address. This may be submitted via email to cda_pesticide_dealers@state.co.us. Please reference your license number in your email. Changes in a dealer name, entity, or business location may require a new license.
